FERC Process

Pre-Filing Process

T. W. Phillips is requesting to use the Commission’s Pre-Filing Process because it will allow T. W. Phillips, interested stakeholders, and the FERC Staff to identify and address potential issues at the earliest time possible and prior to T. W. Phillips filing its NGA §7(c) certificate application. Otherwise, under the traditional National Environmental Policy Act (“NEPA”) review process, some potential issues may not be identified until after an application is filed with the FERC. As part of the Commission’s Pre-Filing Process, T. W. Phillips will meet with stakeholders and prepare draft Environmental Resource Reports for the FERC Staff to review and comment, and the FERC Staff will conduct NEPA scoping before an application is filed. This will allow T. W. Phillips to identify and address stakeholder issues and prepare a more complete application. For more information about the Pre-Filing Process please visit the FERC website.

FERC Application Review Process

FERC approves the location, construction, and operation of pipelines involved in the interstate movement of natural gas. Once T. W. Phillips files an application requesting FERC to issue a certificate authorizing the construction of a pipeline project, the company will mail information to stakeholders. Once the project is thoroughly reviewed by FERC in cooperation with state and federal agencies, a certificate of public convenience and necessity will be granted. T. W. Phillips anticipates submitting an application to the FERC in the fall of 2008 and construction of the pipeline is expected to commence in the spring of 2009.
